An inquiry by FOX 5 Atlanta to the Athens-Clarke County Police Department received a reply stating that offenses like DUI and reckless driving require an arrest. They emphasized that discretion can be applied under certain circumstances, but clearly in this case, there was none. The arresting officer noted White "showed complete disregard for the safety of his passengers, himself and innocent civilians" at a time when the area was peppered with pedestrians, conjuring a threat to public safety.

The arresting officer's report states, White was "traveling at a high speed" with a passenger hanging out a window during the incident. Despite the gravity of his actions, once pulled over, White complied with police without further incident, the handcuffs having him booked faster than he was speeding, as per The Atlanta Journal-Constitution report.
