The Tennessee Occupational Safety and Health Administration (TOSHA) has decided to issue no citations in the November 2023 accident that claimed the life of an 86-year-old FedEx hub worker in Memphis. The employee, Verna Mae Jackson, succumbed to injuries sustained after being struck by a dolly at the FedEx World Hub. This incident, which occurred on November 29, has raised questions regarding workplace safety and regulatory oversight.
According to a WVLT report, the driver operating the dolly claimed to have followed all safety protocols by yelling "clear" before proceeding. However, amidst the hubbub of the facility's operations, it was too late when workers began to shout as the dolly, being pushed forward, ensnared Jackson just in front of its front wheels. Documents reveal that Jackson had been warned to not step between dollies, a practice she engaged in to retrieve mis-sorted packages. The noise level at the site was recorded at 84 decibels, yet despite this evidence, TOSHA has decided to not go forward with any charges.
The Memphis-based facility, as detailed in a Daily Memphian article, had experienced similar tragic events in the past, with Jackson's death being the fifth since 2017. A thorough investigation by TOSHA, which included an evaluation of the dolly and forklift involved, found them to be in operational order, and training documentation confirmed that Jackson was indeed instructed on the proper safety procedures.
Despite these findings, Jeffrey Rosenblum, the family's attorney, questioned the sufficiency of the safety measures in place. "The safety precautions that could've protected her were not in place. This was a completely preventable death,” he told Local Memphis. Rosenblum suggested that the absence or failure to properly utilize audible warning signals on the vehicle pulling the mail load was a critical oversight. "And if we believe those precautions had been taken, if that equipment had been purchased or maybe it was there and not maintained appropriately, she wouldn't be dead," Rosenblum asserted.
FedEx, in response to the tragedy, extended their sympathies to Jackson's family and friends. The company emphasized its commitment to safety, stating, “We extend our deepest sympathies to the family and friends who are mourning their loved one. Safety is our highest priority and we are investigating the circumstances of this accident,” as per a statement obtained by local media. Yet with no citations issued, the loss of Verna Mae Jackson remains a stark illustration of the challenges faced ensuring worker safety in high-velocity industrial environments.
