According to the arrest affidavit, police arrived at the scene of the accident Thursday afternoon to find Lopez's Jeep rolled onto its side in a ditch, with the young child ensnared in the back seat. While the child was secured by officers, Lopez reportedly stood on the sidewalk. A witness who called 911 told officers that they observed Lopez use her phone and sit down on the corner instead of calling for emergency services.

Additional allegations surfaced when officers noticed signs of intoxication as they spoke with Lopez. Her eyes were glassy and bloodshot, and an odor of alcohol was detected on her breath. According to FOX 35 Orlando, certified addiction specialist Lui Delgado, emphasized the risks of impaired decision-making, saying, "You may not have a problem with alcohol out there – but if you are drinking and driving, you definitely have a problem with your decision-making."

Following the crash, both Lopez and the child were transported to a hospital where the child received medical care before being placed under the care of the Florida Department of Children and Families. Lopez was booked into Lake County Jail, and her bond was set at $7,000 as the legal system now takes the wheel in what may be a long journey through the courts.
