
Fountain Hills has reminded celebrants that not all fireworks are permissible under Town Code Section 11-1-4. The code, clear in its boundaries, references ARS 36-1601 for a strict definition of "permissible fireworks." Not on the list is anything that is designed or intended to rise into the air and explode or to detonate in the air or to fly above the ground, according to a recent announcement by the town.
Igniting fireworks that are not on the permissible list could see town residents facing a civil offense punishable by a $750.00 fine. This would seem to effectively ensure to quickly curb any unlawful displays. Additionally, if celebrations go sideways and there's a need for police, fire, or medical response, you can also be held responsible for "reasonable costs" related to the incident, the town's announcement warns.
The regulation does not extend to novelty items. If it stays on the ground or whirls about without taking flight, it's likely within the bounds of the law.
