The Hays County Criminal District Attorney's Office has confirmed that a 21-year-old man involved in the fatal shooting of 17-year-old Erick Alejandro Marin on August 5th will not face murder charges. Marin lost his life during a prearranged fight in a drainage area behind homes on the 800 block of Shadow Creek Boulevard in Buda. According to KXAN, the decision was made following the examination of video evidence that indicated Marin was the first to draw and fire a weapon at the scene.
Evidence presented to the grand jury included two videos, captured by witnesses, showing the escalation of violence where different individuals were involved in the confrontation. Based on this evidence, the grand jury opted to "no-bill" the case. After Marin drew his weapon and opened fire, the 21-year-old male, thus far unnamed, took a gun from a nearby juvenile and fired back, causing Marin's death. The District Attorney, Kelly Higgins, declared the response by the surviving 21-year-old male justified, citing it fell within the boundaries of self-defense under Texas law. The announcement was traced closely after public appeals for justice from Marin's mother, Anna Mendivil, who had expressed her desire for the people involved to be held accountable through imprisonment. "I don't want them to die, I want them to go to jail and feel it in there," Mendivil had told CBS Austin in an interview on August 16. Her son's demise is now ruled as a result of defensive action, the path forward for Marin's family in seeking justice is unclear.
