Last Wednesday, after Jennings's 911 call, first responders found the boy with severe injuries, and he was taken to Ascension Macomb-Oakland Hospital before being airlifted to Children's Hospital of Michigan in Detroit. Evidence found by investigators revealed a pattern of abuse, including a video camera that monitored Chulo in his confined space, and text messages between Jennings and Giacchina that joked about the abuse. A photo displayed the child with his shirt stapled to a bedroom wall, apparently as punishment for looking out the window, as per The Detroit News.

Both Jennings and Giacchina were denied bond during their arraignment, with additional firearm-related charges levied against Giacchina. As per FOX 2 Detroit, prosecutor McDonald emphasized the severity of the crime: "What we found can only be described as horrific." She further detailed how Jennings "knew about the abuse and sometimes encouraged it," which was part of the abuse that led to the boy's death.

At a press conference, as per FOX 2 Detroit, McDonald said, "We have spent over 100 hours reviewing extremely disturbing videos and photos," highlighting the extent of the investigation into Chulo's death. Madison Heights Police Chief Brent LeMerise expressed pride in the department's relentless work and first responders' commitment to the case. Both Jennings and Giacchina could face life in prison if convicted, with their next probable cause conference scheduled for August 21.
