
Christopher Khamis Victor Husary, a 36-year-old Hayward man, has been convicted of committing a hate crime and robbery during an El Cerrito protest earlier this year. On January 6, amidst the heated demonstrations related to the Israel-Hamas conflict, Husary forcibly took and burned an Israeli flag from a woman, actions that led to his charges of robbery and the enhancement of a hate crime. "Everyone has the right to express their beliefs under the First Amendment and we deeply appreciate those who bravely stood up for their rights despite attempts by the defendant to silence them," the Contra Costa District Attorney's Office quoted District Attorney Diana Becton.
After pleading guilty, Judge Charles Burch sentenced Husary last Wednesday to 364 days in county jail and two years probation, with his jail sentence to commence on January 2, 2025, the Contra Costa District Attorney's Office announced. Furthermore, after his sentencing and while awaiting the start of his jail term, Husary was arrested by New York City police officers for allegedly harassing a Jewish subway passenger on June 10, showing a pattern of behavior that doesn't seem to be isolated to a singular event Husary, who will be serving time for charges related to his conduct during a demonstration in El Cerrito, remains in the spotlight for incidents beyond the Bay Area.
District Attorney Becton's acknowledgment of the balance between First Amendment rights and actions that constitute a hate crime has been critical to this case. Becton states, "The First Amendment does not protect people who threaten others, cause injury, engage in intimidation, or damage property. And when harmful actions are motivated by bias against a person's race, gender, religion, or national origin, it constitutes a hate crime," according to the Contra Costa District Attorney's Office. This verdict follows after the Contra Costa DA's office initially charged Husary following the protest incident, where he allegedly not only committed arson but also assaulted another woman and took a second Israeli flag from her.
