DeKalb County District Attorney Sherry Boston has concluded her investigation into the officer-involved shooting of 58-year-old John Robert Smith Jr. at the Atlanta VA Medical Center earlier this year, with a decision not to bring charges against the officer involved, citing justification for the use of force. According to the District Attorney's Office, the incident that occurred on January 29, is now closed.
The determination arrived after an exhaustive review of evidence, including body-worn camera footage which portrayed officers in repeated, de-escalating dialogue with Mr. Smith who had expressed suicidal and harmful thoughts; despite their efforts, Mr. Smith brandished a knife, compelling one officer to act in response to a perceived lethal threat to another staff member, "Our office has now closed this case," DA Boston stated in the official announcement, contemplating the matter brings a sense of finality, along with an awareness of the multifaceted challenges that those who have served encounter, "Mr. Smith’s death is a painful reminder of the struggles our veterans face, even long after their service officially ends."
The incident unfolded when Mr. Smith visited the VA Hospital, distressed and openly voicing the potential for harm to himself or others. A VA social worker and medical staff had begun the admission process when the situation escalated. Smith retrieved the knife, and despite attempts to de-escalate, pursued an employee into an enclosed space, prompting the fatal response from law enforcement present.
Sherry Boston expressed her "deepest condolences" to the grieving family, acknowledging her roles as a legal officer and a compassionate individual. She recognized the death as indicative of broader systemic issues affecting veterans. "We grieve with his family," she stated in the official annoucnement, highlighting the challenges faced by those navigating the aftermath of Smith's passing, including aspects of mental health, institutional care, and legal interactions.
