The altercation escalated into gunfire, with Ervin sustaining a non-life-threatening injury for which he sought treatment at Southern Hills Medical Center. A handgun and ammunition were later retrieved from his Jeep Grand Cherokee. Meanwhile, roughly a quarter mile from the scene, at 476 Bell Road, a passerby suffered a graze wound from shrapnel outside Extreme Cuts Barber Shop. Despite the injury, he denied the need for hospitalization.

After being discharged from the hospital, Ervin was taken into custody on charges including aggravated assault, reckless endangerment, and being a felon in possession of a weapon. His bond is set at $190,000. This arrest marks his third for this year, having previously been arrested in July for an incident at TNT's Billiards Bar and Grill and in February for DUI and possession of a weapon. He had been free on bonds amounting to $64,000 for those charges. Ervin's criminal record lists him as a registered ex-con for weapons and drug offenses.
