
The complex legal proceedings surrounding the tragic death of Augusta University nursing student Laken Riley are moving forward as defendant Jose Ibarra prepares for a bench trial this coming Friday. Ibarra, who is facing charges including malice murder, chose to waive his right to a jury trial during a recent pretrial hearing in Clarke County. As FOX 5 Atlanta reported, Superior Court Judge H. Patrick Haggard confirmed the switch to a bench trial after ensuring Ibarra, through a translator, understood the irrevocability of his decision.
This change in trial structure negates a jury selection that was scheduled to begin tomorrow. The decision for a bench trial came after several months filled with pretrial motions and legal maneuverings. Notably, Ibarra’s defense team previously filed a motion to suppress evidence they claimed had been collected unlawfully. However, this motion was denied last week, as stated in a WSBTV article, with the judge ruling that the evidence, which includes fingerprints found on Ibarra’s phones, could be utilized in court.
Jose Ibarra stands accused of murdering Laken Riley on February 22 while she was jogging on the University of Georgia’s campus. The defendant has entered a plea of not guilty. The prosecution and defense are ready to present their arguments in a case that has garnered significant attention due to the horrific nature of the crime and the young life it claimed.
