During the exchange with the police officers, despite being surrounded by police, Berg conceded to having fentanyl both on his person and inside his vehicle. A subsequent search by the police revealed a hoard of drugs and paraphernalia: Livermore PD discovered "43 grams of fentanyl (including packaging), equating to 21,885 lethal doses, 1.65 grams of methamphetamine (including packaging), 12 small clear plastic baggies and a case of razors, two functional digital scales, $185 in cash, consisting of $20, $10, and $5 denominations," the statement read. The amount of fentanyl present, which far surpasses anything near personal use, led officers to determine that Berg's intent encompassed beyond mere possession.
The evidence arrayed before the officers pointed to Berg's intent to distribute. He was subsequently arrested on multiple charges, including transporting or selling narcotics, possession with intent for the sale of narcotics, and having unlawful paraphernalia.
