
In a courtroom drama that has captivated Hardee County, Tracey Nix, 67, was found guilty of leaving a child unattended in a vehicle causing great bodily harm but acquitted on the charge of aggravated manslaughter of a child. Nix faced these charges after her granddaughter, 7-month-old Uriel Schock, tragically perished from hyperthermia when left in a hot car. According to WFLA, the medical examiner confirmed the cause of death during the trial proceedings yesterday.
The jury's decision clearly reflects the challenge to rationalize between an act of criminal negligence and an unfathomable accident. The case was further complicated by the exclusion of an earlier incident involving Nix when another grandchild, Ezra Schock, drowned in her care. Kaila Nix, mother of the deceased children, voiced her distress stating, "I've lost a lot more" than her children, as reported by WFLA.
While the prosecution sought to prove Nix's culpable negligence, defense attorney Bill Fletcher argued the incident was an accident. "Please don't make this terrible situation worse by convicting Tracey Nix of something that she's not guilty of," Fletcher implored the jury during closing arguments, reported by WFLA. Despite this plea, the jury found there was enough evidence to convict on the lesser charge, which carries a maximum sentence of up to five years in prison.
Meanwhile, Kaila Nix, in a moment of mixed emotion, struggled to view the proceedings as a victory. "It isn't something that I would ever call a win for me," Kaila said, according to an ABC Action News interview. However, she also acknowledged "It is a win for justice for my daughter." Fletcher's response to the outcome was to thank the jury for their decision, while also indicating plans to appeal, as mentioned in an interview with ABC Action News.
