An investigation is underway after a Honolulu doctor is alleged to have violated Hawaii's assisted death law leading to a murder probe, this incident marks the first time the law has come under such scrutiny since its enactment in 201. Honolulu police suspect a 73-year-old male doctor of second-degree murder for his role in the death of an 88-year-old woman

According to reports by The Star-Advertiser, the doctor allegedly assisted in administering a prescribed lethal dose that ultimately resulted in the patient’s choking on October 9, 2024, police said the investigation found that she motioned for the doctor to stop, but despite this he continued to administer the medication and that an autopsy determined the death to be a homicide

Hawaii's Our Care, Our Choice Act, allows a terminally ill patient to obtain a lethal dose of medication, provided it is self-administered. The law requires a conscious, voluntary act by the individual to take the medication into their body to end their life, and "self-administer" clearly mandates this personal action, as per KITV report.

The case, now categorized as homicide by the Medical Examiner’s Office, has led to the Honolulu Police Department's execution of a search warrant at the doctor's residence for evidence related to the woman's death, while no arrests have been made as of yet, HPD highlighted that this is the first homicide investigation involving the Our Care, Our Choice Act, according to details obtained by KITV.

The investigation is ongoing to determine the circumstances of the woman’s death. However, police have not released further information at this time.
