
The trial for the 2023 shooting death of Adam Michael Fresquez at a car charging station commenced with jury selection this Tuesday, marking the beginning of the legal proceedings against Jeremy Alan Smith, the man accused of second-degree murder and manslaughter. Lena Fresquez Mendez, the mother of the deceased, has been present at every court date leading up to this trial, struggling to come to terms with the surreal reality of her son's absence. "I don't know that there is a way to prepare [for this trial]," Mendez said, as quoted by CPR. "We've been living this for almost 21 months, and now we're finally going to trial and it doesn't feel real still."
The case, which involves an altercation at an Edgewater Public Market's Tesla charging station, was initiated by a road rage incident captured on video presented by the prosecution. As Denver7 reported, prosecutors believe both men were equally culpable for the road rage, but emphasized that although Fresquez had a gun, he never brandished it nor posed an imminent threat to Smith. The defense, conversely, is framing Smith as the victim, suggesting Fresquez was the aggressor looking to escalate the incident into a confrontation.
As further details of the case continue to unravel in court, arguments from both sides are scrutinized over the issue of self-defense. Smith's lawyers argue that their client was backed into a corner by Fresquez's aggression. "Smith was acting in self-defense," Smith's defense team contended, as reported by Denver7. They paint a picture of Smith being forced into action by the belligerent behavior of Fresquez.
