
After more than three decades of waiting, justice has finally been served in a 1993 Austin cold case. A Travis County jury convicted 66-year-old Douglas Birden of two counts of aggravated sexual assault of a child, sentencing him to 30 years in prison—the verdict coming in for an assault that has haunted the victim and the community since November of '93. The conviction was reported by CBS Austin, which detailed the crime committed by Birden against a then-13-year-old girl who was abducted at gunpoint while on her way home from basketball practice.
The pivotal break in the case arrived courtesy of a DNA match facilitated by the National Sexual Assault Kit Initiative, a federal grant program that allocates funding to process untested sexual assault kits. DNA from the victim's 1993 examination was matched to Birden's profile in July 2020, which was in the Combined DNA Index System. According to KVUE, the match was confirmed after a search warrant authorized the collection of a new DNA sample from Birden, leading to his February 2022 arrest by the Killeen Police Department's SWAT team.
Travis County District Attorney José Garza emphasized the importance of collaboration and federal support in securing the conviction, saying "This conviction is the result of a close collaboration between the Travis County District Attorney’s Office and our law enforcement partners. Together, and with the support of the federal grant, we worked diligently to ensure that the victim in this case received the justice they rightfully deserved decades ago,” as reported by CBS Austin.
These federal grants notably impacted the Austin area, with the city receiving $3 million between 2017 and 2018 to process over 3,700 untested sexual assault kits. These funds not only aided the investigations but also provided necessary support services to victims.
