In the course of their investigation, deputies identified the assailant as Ezequiel Perez, the child's father, who was accused of repeatedly assaulting the infant, resulting in pain and visible injuries needing medical treatment. Having been arrested, Perez was taken to Harris County Jail with charges of injury to a child against him.

Constable Mark Herman made a statement in a social media post, "Ezequiel Perez was arrested and booked into the Harris County Jail, charged with Injury to a Child." However, information regarding Perez's bond remains undisclosed, as it had not been set by the 183rd District Court at the time of the reports.
