
Friends and family of Arlene Alvarez gathered at Lawndale Forest Park’s Garden of the Angels for a memorial on the third anniversary of her death. Arlene, 9, was killed on February 14, 2022, by a stray bullet fired by Tony Earls, who was reportedly aiming at a robbery suspect near an ATM. The family also addressed the delay of Earls' murder trial, which was moved from January to August 2025 due to a prosecutorial change. In a statement to Click2Houston, they said, "Sean Teare fired our prosecutor, Warren Diepraam, on 1/1/2025," and noted John Jordan as the new prosecutor.
Tony Earls appeared in court as a trial date was set for June 16 in his murder case, according to KHOU 11. Arlene’s family has raised concerns about whether the new Harris County District Attorney, Sean Teare, will impact their assigned prosecutor’s role in the case.
April Aguirre, Arlene Alvarez’s aunt, voiced concern over a prosecutorial change, stating, "To take away our prosecutor at this moment in time when Arlene's anniversary is going to be in February and it will hit three years since her death is detrimental to our case." The case against Tony Earls has progressed from aggravated assault to murder, with changes including a lower bond and upcoming court proceedings later this year. In response, prosecutor Sean Teare said, "Rest assured, we will prosecute this case. I will be meeting with the Alvarez family—answering their questions and hearing their concerns is a priority." The Alvarez family continues to follow the legal process while marking the anniversary of Arlene’s death, as stated by KHOU 11.
