A Jamaican man with a history of felonies has been apprehended after an alleged illegal re-entry attempt at the Paso Del Norte Port of Entry. As reported by the U.S. Attorney’s Office, Dwight Donovan Moulton, who is 43, was caught by Customs and Border Protection when trying to pass off as a United States citizen with a Texas identification card.
It was when Moulton was subjected to a secondary inspection by a Customs and Border Protection officer that facial discrepancies were noticed between the photo on the ID and Moulton himself. According to court documents, during his visit to the Passport Control Secondary office, Moulton dropped the act and confirmed his Jamaican citizenship. These court documents also claim Moulton admitted to finding the ID card he presented and intended to use it to get to El Paso.
Moulton's prior criminal record is not one to be taken lightly. Since his last deportation to Jamaica on September 22, 2005, he's accumulated three felonies, including firearm possession and the sale of a controlled substance. If convicted for this latest charge of illegal re-entry, he faces up to 10 years of imprisonment.
The announcement of Moulton's arrest and charges was made by Acting U.S. Attorney Margaret Leachman for the Western District of Texas, who noted that "a federal district court judge will determine any sentence after considering the U.S. Sentencing Guidelines and other statutory factors." Representing the government's case against Moulton is Assistant U.S. Attorney Patricia Aguayo. On the side investigating the matter is Customs and Border Protection. It was stressed that, even though these charges are serious, "a criminal complaint is merely an allegation and all defendants are presumed innocent until proven guilty beyond a reasonable doubt in a court of law," as noted by the U.S. Attorney’s Office.
