According to the announcement, a federal jury in July 2024 found Gutierrez guilty on one count of distribution of fentanyl resulting in death and serious bodily injury; he has been in custody since May 2023 and Acting United States Attorney Joseph McNally highlighted the devastating impact of fentanyl distribution on families and communities, committing to holding responsible those who fuel this crisis "Today’s sentencing serves as a reminder that those who peddle these lethal drugs and fuel this crisis will be held accountable for the destruction they cause."

During the trial, evidence showed that Gutierrez provided fentanyl to a co-defendant, 37-year-old Jayleen Feusier of South Gate, who then made it available to the eventual victim, while residing at a rehabilitation center, Feusier packaged the fentanyl and used an Uber delivery service to send it to the man tracking the package from Gutierrez's home to the rehab facility using a link provided by Feusier.

Special Agent in Charge of the DEA's Los Angeles Field Division, Matthew Allen, emphasized the drug distributors' greed and indifference to the plights of individuals battling addiction, saying "They are indifferent to the stories, vulnerabilities, and the struggles of those tunneling through addiction and recovery," and noted DEA's partnership with federal and local agencies to prosecute such offenders; the investigation involved DEA and Long Beach Police Department, and the case was prosecuted by Assistant United States Attorneys Jeremy K. Beecher and Danbee C. Kim.

Feusier, who admitted to possession with intent to distribute fentanyl, received a 100-month prison sentence in August 2024, after pleading guilty to her charge.
