The incident is reported to have occurred on the morning of February 2nd. The Joliet Police received calls about a suspicious incident at the athletic club, located at 3000 West Jefferson Street. Theis was working as a third-party vending machine worker at the time of the alleged offense. Upon reviewing the evidence, authorities claim to have found images on his cell phone that led to his arrest. Theis is accused of having taken photos of the boys using the facilities, seemingly disregarding the terms of his past crimes.

Following the initial response, a staff member of the athletic facility confronted Theis about his activities that morning. This confrontation led to law enforcement being notified of the situation. As per a FOX 32 Chicago report, the police later identified Theis as a suspect through further investigation, which confirmed his status as a convicted child sex offender.

The arrest warrant for Theis was obtained on a Monday, and by Tuesday, a traffic stop in Romeoville concluded in his arrest. The charges he faces include child pornography by a sex offender, which layer onto his already existing status as a sex offender.
