In a federal courtroom in Del Rio, the grim realities of human smuggling operations were laid bare as Nicacio Arellano-Garcia, a 34-year-old Mexican national, stood convicted for his role in a conspiracy to transport illegal aliens through unforgiving terrain. As reported by the United States Attorney's Office for the Western District of Texas, a jury found Arellano-Garcia guilty on two counts, one for conspiracy and another for transporting illegal aliens in a manner that placed their lives in jeopardy.
Evidence at the trial highlighted Arellano-Garcia's role as a foot guide, responsible for leading five individuals on a perilous two-day journey through the rough brush. His co-defendant, Alexander Galvez-Zelaya of Honduras, was the driver slated to collect the group. During this trek, tragedy struck when one of the illegal aliens fainted and later died from the harsh combination of dehydration and exposure. This distressing tale underscores the peril faced by many in their attempt to cross borders under the guidance of smugglers.
The situation quickly escalated into a high-speed chase surpassing speeds of 100 miles per hour when Galvez-Zelaya, trying to elude law enforcement, crashed into a fence on private property near La Pryor in Zavala County. The aftermath of the crash resulted in the arrest of both Arellano-Garcia and Galvez-Zelaya, with a subsequent investigation confirming their illegal status in the U.S.
Galvez-Zelaya had previously entered a guilty plea to one count of conspiracy to transport aliens placing lives in jeopardy on November 4, 2024, with his sentencing scheduled for May 28. Each of the counts against the defendants carries a potential prison sentence of up to 20 years. Acting U.S. Attorney Margaret Leachman, representing the Western District of Texas, announced the convictions, highlighting the ongoing efforts to combat such criminal enterprises.
The prosecutions form part of Operation Take Back America, an expansive initiative set forth by the Department of Justice to combat illegal immigration, dismantle cartels, and suppress transnational criminal organizations. With Homeland Security Investigations at the helm, Assistant U.S. Attorneys Warsame Galaydh and Matt Kass are leading the charge on this particular case, their prosecutorial eyes set firmly on upholding justice and protecting communities from the dangers these criminal actions pose.
