Michigan's top legal eagle, Attorney General Dana Nessel, is flying in formation with a coalition of her counterparts from 27 other states to bolster the fight against robocalls. In an amicus brief, they flew to court, and these AGs threw their weight behind the Federal Communications Commission’s One-to-One Consent Rule. Aiming to torpedo the barrage of robocalls that consumers have been besieged by, the rule mandates telemarketers get a clear yes from folks before dialing them up or peddling their digits to others.

Despite being a solid piece of the puzzle in the fight against these nuisance calls, the rule was recently struck down by the Eleventh Circuit, which believed the FCC was sticking its nose where it shouldn’t. According to the Michigan Department of Attorney General, scammers using robocalls and texts swiped more than $1.2 billion from consumers in 2023. Nessel and her AG coalition buddies argue that the FCC has the authority under the Telephone Consumer Protection Act to enforce these rules, which help prevent consumers' information from being hijacked for profit.

Attorney General Nessel detailed the necessity of the rule, saying, per the Michigan Department of Attorney General, "My colleagues and I have worked hard to crack down on illegal robocalls in our states, and this FCC rule is a crucial tool for stopping these relentless, intrusive calls at the source." She highlighted the rule's importance in empowering consumers to dictate who can buzz their phones.
