A New Orleans man has found himself on the wrong side of the law after a recent indictment was unsealed, detailing an alleged violation of federal firearm laws. Haven Patterson, 42, stands accused of being a felon in possession of firearms – a considerable charge with serious potential penalties. According to an indictment, Patterson allegedly had in his possession two loaded handguns, specifically a Smith & Wesson SD40 and a Smith & Wesson M&P Bodyguard 380.
Patterson's past as a convicted felon makes it illegal for him to own or possess firearms or ammunition, as laid out by Title 18, United States Code, Section 922(g)(1). The gravity of this accusation is underscored by the potential sentence he faces if found guilty, which could easily include up to 15 years in prison and a hefty fine reaching $250,000. Additionally, there's the possibility of up to 3 years of supervised release and the expected special assessment fee of $100, as noted by the Department of Justice release.
It's important to note, as Acting U.S. Attorney Simpson did, that the indictment only serves as a formal charge. Patterson's legal journey continues as he must be proven guilty beyond a reasonable doubt before any sentence can be pronounced. The burden of proof lies heavily on the shoulders of the prosecution, led by Assistant U.S. Attorney Chandra Menon of the Public Integrity Unit.
