
A Mexican national with a previous conviction for indecency with a child was apprehended in El Paso, facing new charges of alleged illegal re-entry into the United States. Court documents reveal that 47-year-old Clemente Galvez-Alapisco, hailing from Sinaloa, Mexico, has been deported on two occasions, the latest being June 28, 2022, following his conviction for a sexual offense involving a child. According to the U.S. Attorney's Office for the Western District of Texas, Galvez-Alapisco was also found guilty of illegal re-entry in July 2019 and served a five-month and 11-day sentence.
Should the courts find him guilty once more, the defendant could face up to 10 years in federal prison. A sentence, if imposed, will be at the discretion of a federal district court judge who will consider the U.S. Sentencing Guidelines along with other statutory factors. Acting U.S. Attorney Margaret Leachman for the Western District of Texas announced the arrest, with the case being investigated by the U.S. Border Patrol. The responsibility for prosecuting the case falls to Assistant U.S. Attorney Patricia Aguayo.
It's important to remember that a criminal complaint is an allegation and not a proof of guilt. Galvez-Alapisco, like all defendants, commands the presumption of innocence until, and unless, proven guilty in a court of law beyond a reasonable doubt.
