Officers responded to a report of theft in progress and found the suspects, identified by police as 61-year-old Tyrone Lee Jones and 45-year-old Nicole Natasha Turbin, with a cart and bag full of items they had not paid for. In addition to the stolen goods, both suspects were found to have drugs and drug paraphernalia.

The arrests came into effect under the recent passing of Proposition 36, which enables charges to escalate from misdemeanors to felonies if the individuals have two or more prior convictions, the Benicia Police Department noted. In this instance, both Jones and Turbin had more than two prior theft and narcotics convictions, which allowed officers to book them on felony theft and narcotics charges, as stated by the Benicia Police Department's Facebook page.

Details about the suspects showed Jones and Turbin were taken into custody on the 2100 Block of Columbus Pk. According to an arrest record posted by the Benicia Police, Jones faces multiple charges, including possession of a controlled substance with two prior convictions, conspiracy to commit a crime, theft with two prior convictions, and possession of unlawful paraphernalia. Turbin was arrested on similar grounds, and she also faces a probation violation charge.
