"When we can no longer prove the original charge beyond a reasonable doubt, the right thing to do is to dismiss the charges and add the appropriate charge. Aside from the animal cruelty case, Kucharski is facing additional unrelated charges in St. Clair County. These include arson in the second degree, assault with a dangerous weapon, and resisting a police officer—each may carry a significant prison term. He has been arraigned on these counts, with a bond set at $5,000 cash/surety by 72nd Port Huron District Court Magistrate Dennis Rickert. A Probable Cause Hearing is scheduled for March 25, which Macomb County detailed.
