The convicted, Sushil Kumar, 35, along with two partners, were caught in connection to smuggling incidents in November and December 2023. During sentencing, U.S. District Judge Tana Lin pointed out the susceptibility of the smuggled individuals. According to ICE, Judge Lin remarked, "That they wanted to be in the country doesn’t mean they were not exploited. Each was charged $5,000 to $10,000 which is months or years of their salary in the country from which they were coming… Human smuggling undermines our country’s ability to regulate the border at a real cost."

The scheme involved the illegal crossing of eight Indian citizens. On November 27, 2023, border patrol agents responded to motion-activated cameras capturing several individuals jumping a fence by Boundary Village Apartments in Blaine, Washington, led them to a white minivan chase that ended with Bobby Joe Green, 68, and five illegal aliens detained. The fence in question sat mere paces from the international divide, where vigilant eyes constantly sought to keep the threshold secure. Some of the apprehended migrants revealed they had seen Kumar at Peace Arch Park before their illegal crossing and had been given specific instructions from him, as reported by ICE's announcement.

Similarly, in December 2023, Kumar's co-conspirator, Rajat Rajat, 26, was involved in directing three Indian nationals on how to surreptitiously cross the border at Peace Arch Park. All defendants except Sneha, a 20-year-old student visa holder who awaits trial, have entered guilty pleas. Sentencing for Rajat is set for April 23, while Bobby Joe Green's sentencing occurred last Thursday, as per the statement obtained by ICE.
