Valentin Hernandez-Yanez, a 38-year-old Mexican national, faced the finality of the U.S. legal system as he was sentenced for illegally reentering the United States, in a judgement handed down in the Eastern District of Texas. According to the U.S. Attorney's Office, Hernandez-Yanez pleaded guilty to the charge and received a sentence equal to the time he had already been incarcerated since July 2024.
U.S. District Judge Michael Truncale issued the sentence yesterday, and Hernandez-Yanez will remain in custody under an immigration detainer while awaiting the actions of Homeland Security to facilitate his deportation to Mexico.
Federal immigration agents encountered Hernandez-Yanez in Vidor, Texas, a location where they had prior knowledge of him. This led to a check against immigration databases, revealing that he had been deported to Mexico in June 2011, with no legal requests for reentry since. This confirmed his presence in the U.S. as unlawful.
The case against Hernandez-Yanez is part of a larger effort under Operation Take Back America, a broad initiative supported by entities like the Department’s Organized Crime Drug Enforcement Task Forces and Project Safe Neighborhood. The mission focuses on protecting communities from violent crime. This case was prosecuted by Assistant U.S. Attorney Matt Quinn and investigated by Homeland Security Investigations, affirming the process through which Hernandez-Yanez navigated the U.S. justice system.
