In a turn that further underscores the accountability sought in the aftermath of the Paycheck Protection Program (PPP) disbursements, Miramar mayoral candidate and business owner Rudy Theophin has entered a guilty plea on charges of wire fraud associated with the misuse of COVID relief funds. As reported by the U.S. Department of Justice, the 41-year-old was the president and sole owner of Theophin Consulting LLC, submitting a fraudulent application in June 2020 for a loan intended to support businesses during the pandemic-induced economic downturn.
Theophin's application claimed false employee numbers, and inflated monthly payroll figures allowing him to secure $123,675, funds that he did not use to support his business or its employees but rather shuffled into personal endeavors including aiding an associate, an investment account, and a condominium purchase, this course of action has brought him into legal jeopardy and now entangled in the slower gears of justice a sentencing hearing is set on July 15 at the Fort Lauderdale U.S. District Court with U.S. District Court Judge Rodney Smith presiding.
While Theophin faces a severe potential sentence of up to two decades behind bars, the move to a plea suggests a possible reduction in what could have been an even stiffer penalty had the case gone to trial. The pivotal investigation actioned by IRS-CI and their partners has culminated in Theophin's admission of guilt, clarifying his departure from the guidelines of PPP eligibility and appropriate use. His conviction draws a line under highly publicized instances of fraud during a period of significant economic vulnerability, as detailed by the same press release.
The prosecution was led by Assistant U.S. Attorney Christopher Killoran, and the asset forfeiture by Assistant U.S. Attorney Jorge Delgado. As the legal proceedings continue, the story will continue unfolding through updates in court documents, which can be accessed through the Southern District of Florida's court website.
