Attorney General Dave Sunday has taken legal action against Philadelphia contractor Michael Davis and his company, 1st Choice Roofing, Inc., over allegations of shoddy workmanship and unissued refunds. According to the lawsuit, Davis and his firm contravened the Home Improvement Consumer Protection Act by excluding vital contract elements and failing to deliver on consumer promises.
The Office of the Attorney General has encouraged those who believe they've been aggrieved by Davis or his business to come forward. This comes after the Office received numerous complaints. "Home upgrades improve quality of life and instill a sense of pride in homeowners. In these cases, consumers dealt with subpar work and were ignored when they requested refunds," Attorney General Sunday stated, emphasizing the commitment to safeguarding consumers. The lawsuit seeks restitution for impacted consumers, legal penalties, and for Davis and his company to adhere to consumer protection laws.
Disgruntled customers have reported incomplete and poorly executed work, as well as unanswered refund requests. This includes an account of an individual paying a $500 deposit for chimney repairs that never commenced, with subsequent refunds ignored. Senior Deputy Attorney General James S. Wise has filed the lawsuit in the Philadelphia County Court of Common Pleas and is currently pending acceptance by the court.
