Deputies managed to extract both the driver, Maria Elena Menjivar, 51, and passenger, Emilio Alfaro-Herrera, 54, from the flaming wreckage. The two were rushed to Tampa General Hospital, where Alfaro-Herrera was pronounced dead, Menjivar, sustained minor injuries. In a twist of fate that spares no one, irrespective of intent or circumstance, a high blood alcohol concentration of 0.200—more than twice the legal limit—sealed Menjivar's role in the tragic narrative.

According to the Hillsborough County Sheriff's Office, their investigation revealed "clear signs of impairment" from Menjivar. Sheriff Chad Chronister commented on the incident and laid bare the stark reality of impaired driving. "There is no excuse for getting behind the wheel while impaired," he said. "One reckless decision took an innocent life. This tragedy should remind us all how devastating the consequences of impaired driving can be."

While Menjivar now faces an uncertain future with a charge of DUI Manslaughter hanging over her head, a family, and community reel from the sudden loss of Alfaro-Herrera. Sheriff Chronister extended his sympathies on behalf of the sheriff's office, acknowledging the deep impact on the victim's loved ones, "Our hearts go out to the victim's loved ones," the HCSO's statement revealed, a succinct bow to the gravity of loss and the road not taken, due to one irreversible decision.
