The Arizona Department of Education (AZED) has launched a webpage that catalogs the status of school districts and charter operators in regards to federal DEI guidance, a move that underscores the ongoing legal complexities surrounding the issue.
The page serves as an inventory, remaining informational amid a spate of court challenges, detailing those institutions that have either affirmed or failed to certify their alignment with the federal government's directives on DEI. Although the U.S. Department of Education has pressed pause on enforcement, pending litigation, local educational agencies are listed on the site, providing transparency, the efforts to navigate these legal waters are complicated by active lawsuits that question the future of these federal mandates. AZED's recently published page is a clear bid to honor this commitment amidst a legal holding pattern.
Tom Horne, State Superintendent of Public Instruction, expressed his intention to walk the line between legal abidance and his stated beliefs on the matter, "I am committed to following the law and will abide by the latest guidance from the U.S. Department of Education to take no action against schools until further notice," Horne's statement clarified, highlighting a stance against what he perceives as the discriminatory nature of DEI programs. "I also made a commitment to transparency by listing the districts and charters that have responded to the earlier DEI guidance," he added, juxtaposing the government's direction with his assertion that "the use of DEI programs does just the opposite and promotes racial discrimination."
Strong assurances were given by Horne on the issue's endurance, saying, "I believe the DEI guidance will eventually be upheld by the U.S. Supreme Court and districts and charter schools need to treat this issue seriously."
