Bercaw affirmed that the act was not accidental, but rooted in the "driver's criminal actions and reckless decision to operate a vehicle while impaired."

Details of the incident, which took place on May 24, suggest Hernandez attempted to "beat the light" as it changed to yellow, ultimately speeding through a red signal, resulting in the catastrophic crash. The driver of the Lexus sustained severe injuries and despite rapid transport to the hospital, was pronounced dead at 4:06 am.

Alongside the fatality charges, Hernandez has also been charged with driving without a valid driver's license, with death or serious bodily injury. In the aftermath of the crash, roads were closed to facilitate an investigation and necessary repairs to impacted powerlines, though they have since been reopened.
