
The legal proceedings regarding the Apalachee High School shooting continue to unfold as Colin Gray, the father of the accused shooter, Colt Gray, was back in court this week. At issue is Colin Gray's indictment on 29 charges, including second-degree murder and cruelty to children, directly tied to the tragic events that claimed the lives of two students and two teachers. According to a report by FOX 5 Atlanta, defense attorneys for Gray are challenging the indictment, seeking dismissal or a redraft, stating that the charges are "legally vague."
During the motions hearing, defense attorney Jimmy Berry expressed concerns about the indictment, "I think the indictment just is very vague. It does not put us on notice of exactly what we have to defend," Berry told FOX 5 Atlanta. Prosecutors pushed back, contending that the indictment establishes the defendant's alleged negligence following warnings of his son's potential danger. Colin Gray, has been accused of criminal negligence by allowing his 14-year-old son access to a firearm, the GBI say was used in the deadly shooting. The defense team has also requested a change of venue for the impending trial, citing demographic differences, however, this was challenged by the presiding judge on logistical grounds.
As reported by 11Alive, Judge Nicholas Primm reaffirmed his decision that jurors for Gray's trial will be selected from Hall County, indicating openness to changes should jury selection prove problematic. Gray's counsel raised concerns since some witnesses hail from Hall County. The judge understood the motion but had no intent to grant it at this time.
Colt Gray, the accused gunman, faces a staggering 55 charges, including four counts of murder, with authorities uncovering disturbing evidence including a notebook with drawings similar to the school shooting and a "shrine" of past shooting incidents. While the senior Gray's trial looks to start on September 8, questions linger on whether the younger Gray will have his day in court or settle via a non-negotiated plea.
