Brendan Ross, the founder, and former CEO of Direct Lending Investments LLC, faced justice as United States District Judge Dale S. Fischer sentenced him to 40 months in federal prison for his engagement in a scheme that defrauded investors by millions of dollars, as reported by the U.S. Attorney’s Office for the Central District of California. Fischer also ordered Ross to pay $5.9 million in restitution following his wire fraud plea in August 2022.
DLI, based in La Cañada Flintridge, was once overseeing more than $1 billion in managed assets but Ross’s admission of guilt exposed a fraudulent facade wherein he falsified financial records to heavily inflate the firm's fund value and Ross not only hidden the underperformance of loans within his portfolio, but he also fabricated borrower payments by using fee rebates, misleading clients and investors, according to the indictment. By pumping up the value of these loans, Ross was able to unjustly harvest millions in fees over roughly four years, sums that rightly belonged in the pockets of those who’d entrusted him with their financial futures.
Adding another layer to the scandal, Ross arranged the sale of about $55 million worth of these loans to an unsuspecting third-party buyer in 2017, during which he lied about loan payments to bloat the sale price, but eventually, his web of deceptions unraveled. In a sentencing memorandum, prosecutors highlighted the severe financial strife investors faced, including the depletion of retirement funds and other serious professional and reputational damages.
The Federal Bureau of Investigation spearheaded the inquiry into Ross's dealings, while the U.S. Securities and Exchange Commission lent considerable aid by filing a civil complaint against him, back in August 2020 where they painstakingly pieced together the trail of Ross's deceit, which eventually led to his conviction; Public Information Officer Ciaran McEvoy confirmed the details of Ross's sentencing and restitution.
