McGuire commented on the case, stating, per the Department of Justice, "This settlement shows that the Department of Justice is committed to assisting those with disabilities in having equal access to services offered in our community," reinforcing the importance of not stereotyping members of society based on their disabilities. The heart of the matter involves a claim lodged by the parent of a minor who, despite their cochlear implant and hearing aid, was allegedly refused appropriate communication methods and the ability to participate fully in driver education lessons.
Under the settlement, the Academy has committed itself to nondiscriminatory practices against individuals with disabilities and will provide reasonable modifications and auxiliary aids where needed to ensure effective communication. Moreover, as compensation for the discrimination faced, the Academy will pay the complainant $4,000 and a further $2,000 as a civil penalty to the United States.
