A distressing situation unfolded in Marana, Arizona, when a baby was left unattended in a vehicle, an incident captured in a video that has since gone viral. The Marana Police Department confirmed they have arrested 24-year-old Brody Rago, citing him for leaving a minor in a vehicle, which is considered a misdemeanor. According to 13 News, the incident occurred at the Circle K on Marana Road near Interstate 10 on the sizzling day of July 19, with temperatures reported to be around 101 degrees.
The video, recorded by Erica Ocejo, captured the baby in clear distress in the backseat of the car, crying out and left alone with the keys in the ignition. Ocejo informed police and then filmed the 30-second snippet, showing the moment Rago emerged from the store, carrying a case of beer and then driving away. "I was just in disbelief that there was a baby in the car left alone," Ocejo told FOX 10 Phoenix.
Public records further show that this is not Rago's first brush with the law, having been cited for DUI charges as recently as June. Defense attorney Chris Scileppi emphasized the complex nature of the case, telling 13 News, "It's highly fact-intensive," and pointed out that factors such as the weather and the duration of the child's stay in the vehicle would come into play for the defense.
Marana's laws regarding children left unattended in vehicles are strict, following an ordinance passed in 2009 that prohibits leaving a child under eight years old in a car without supervision of someone at least 12 years old, particularly if the vehicle is running or if, the keys are inside. This tragic incident is a somber echo of a similar case over a year ago in Marana when a father was charged following the death of his 2-year-old daughter who succumbed to the heat in a parked car. As this case unfolds, 13 News has reached out to Rago and his family, and has requested the police report from the Marana Police Department, pledging to keep the public updated on new developments.
