He was charged with felony indecent liberties, proposed sex acts, and aggravated sexual battery of a victim less than 13 years old. In response to these charges, ICE swiftly lodged an immigration detainer with the Fairfax County Adult Detention Center. Nevertheless, the center did not honor the detainer, setting him free without a specified release date.

Though the Fairfax County district attorney ultimately decided not to pursue prosecution on the indecency charges, ICE remains resolute in their decision to deport Perez-Teofani. "ICE will still remove him from the country," the agency announced, reinforcing their stance on immigration law enforcement despite local legal decisions.
