Attorney General John Formella, in statements issued to multiple news outlets, confirmed that Trooper Burgess’s shooting of Infinjer is considered a legally justified use of deadly force under New Hampshire law. Formella stated, "During that incident, Trooper Burgess fired several shots at Ms. Infinjer, striking her once in the shoulder." No other injuries were reported during the encounter. Infinjer was transported to a local hospital with non-life-threatening injuries.
