The death of a Bronx man in Rikers Island custody has raised serious concerns, marking the 11th fatality this year within the corrections facility. Jimmy Avila, who was arrested on charges of murder and attempted murder following a shooting in Claremont, died in the jail's West Facility just three days after his apprehension. The City Department of Correction is actively investigating the circumstances of his death, which occurred on Saturday at 4:29 p.m. after attempts to revive him failed, Gothamist reports.
Caught up in the aftermath of a recent surge in Bronx shootings, Avila had allegedly fatally shot a building superintendent, Ryan Hines, and wounded two others. Seeking to stem the tide of violence, the city's mayor deployed additional police officers to the borough over the weekend. According to PIX11, sources claim a dispute over backyard access escalated into the tragic confrontation.
Inconsistencies regarding Avila's age have surfaced, with the Department of Correction recording him as 34 years old, while police records show he was 44. The discrepancy adds another layer to the unfolding inquiry as officials have yet to provide details on why Avila required medical attention prior to his death. His next court appearance had been scheduled for tomorrow, as per court records.
The Legal Aid Society, which represented Avila, expressed distress over his passing and the manner in which they were informed, claiming notification came through a press release rather than direct contact from the DOC. "With each of these deaths, the City responds with the same boilerplate language, but conditions don’t improve, the people we represent continue to suffer, and these tragic deaths continue to mount," a spokesperson for the Legal Aid Society said in a statement obtained by Gothamist. Recently, following the death of 29-year-old Ardit Billa at Rikers, three staff members were suspended, indicating ongoing issues within the penitentiary.
New York City Corrections Commissioner Lynelle Maginley-Liddie expressed condolences regarding Avila's passing, saying, "Our hearts are heavy with the loss of an individual in our care. We mourn his passing and extend our sympathies to his loved ones," as reported by PIX11.
