As observed by a FOX 32 crew, U.S. Marshals and federal agents were seen entering and exiting the facility on Foster Avenue. Following the operation, agents displayed various vaping products on tables outside the warehouse.

The raid seems to coincide with a scheduled news conference by U.S. Attorney General Pam Bondi and Health and Human Services Secretary Robert F. According to a statement obtained by CBS Chicago, Midwest Goods characterized the federal action as a "civil seizure" executed by the Food and Drug Administration and U.S. Marshals.

Midwest Goods asserted that the seized items primarily included e-liquids for refillable, open-system electronic nicotine delivery system (ENDS) devices, spanning over 75 brands. The company claimed in their statement that many of these products have had premarket tobacco product applications pending with the FDA for several years, with some dating back to September 9, 2020. Prior to the raid, the company had communicated with the FDA following an inspection in August and had even removed certain products from their inventory as a sign of compliance.

The company expressed concern over recent developments, stating, "We find the FDA's actions particularly troubling given reports earlier this week that FDA plans to expedite within a matter of months, reviews of several tobacco products manufactured by Big Tobacco companies," according to the same statement. Midwest Goods described this as particularly disconcerting, given that these applications were supposedly submitted years after some of the products currently seized from their warehouse. Despite the raid, Midwest Goods emphasized their willingness to continue cooperating with federal authorities and to defend their rights in court if necessary.

At present, CBS News Chicago reports it has reached out to the U.S. Marshals and other law enforcement agencies for comments on the raid but has yet to receive a response. Midwest Goods, known for distributing a wide range of vape and electronic cigarette supplies, including disposables, vaping liquid, pod systems, and other related paraphernalia like pipes and bongs, continues to stand by their compliance efforts and the legality of their business operations.
