According to his official statement, Abbott's freshly inked order aims to shore up protections for minors, a directive launched in the wake of the Texas Legislature's failure to pass measures limiting the sale of such products to those under 21 years of age.
Fortifying the frontier between children and hemp-derived products, the order specifically instructs the Department of State Health Services (DSHS), the Alcoholic Beverage Commission (TABC), and the Department of Public Safety (DPS) to immediately begin enforcing new restrictions. From now on, retailers are to rigorously check and verify government-issued IDs to ensure no hemp sale slips through to a minor, lest they risk losing their license to sell. "Texas will not wait when it comes to protecting children and families," Governor Abbott declared, vowing to safeguard young Texans while striking a balance between strict regulation and adult liberties.
Abbott's decree has far-reaching implications for the hemp business landscape. The DSHS is tasked with a comprehensive review of its rules that may culminate in tougher testing and labeling requirements, alongside heightened licensing fees to underpin enforcement efforts. Equally, this executive push envisions enhanced recordkeeping to support agency oversight. In parallel efforts, DSHS, TABC, and DPS are expected to coordinate a step-up in state-wide policing of the hemp trade, with local law enforcement drafted as partners in this crackdown.
In addition, the TABC and DSHS, in concert with Texas A&M AgriLife Extension Service and other relevant entities, are to commence an exploratory study on establishing a comprehensive regulatory framework, akin to that envisaged in House Bill 309. This venture seeks to ultimately lay down an enforceable system, one that's thoroughly transparent and is capable to robustly crack down on any abuses of hemp product usage while preserving responsible adult access.
