Florida’s First District Court of Appeal has ruled the state’s Open Carry Ban unconstitutional, according to the Jacksonville Sheriff’s Office. The court’s decision on Wednesday overturns Florida Statute 790.053, which banned the open carry of firearms.

As per the Jacksonville Sheriff's Office News, following the ruling, the Jacksonville Sheriff’s Office instructed officers that openly carrying a firearm is no longer grounds for detainment or arrest. Adults legally allowed to possess firearms may now carry them openly in most public places. Private property owners and businesses may still prohibit firearms on their premises.

Open carry remains prohibited in certain locations, including courthouses, police and sheriff’s offices, government buildings, and educational institutions from K–12 schools to colleges and universities. Convicted felons and individuals actively committing crimes are also barred from firearm possession.

The Jacksonville Sheriff’s Office stated on its website that open carry is permitted in public, unrestricted areas, outlining where the ruling applies.
