
The Office of the Attorney General in New York has initiated an inquiry into the demise of a civilian named James Rosano in Nassau County after a confrontation with the Nassau County Police Department (NCPD). On Wednesday, as reported by the Attorney General's Office, police responded to a distress call at a Carle Place residence, where they met Rosano holding what seemed to be a firearm, then later a police officer fired at Rosano following his non-compliance to surrender the assumed weapon.
According to the preliminary details shared by the Attorney General's press release, the incident unfolded in the early hours when officers approached Mr. Rosano and gave him clear instructions to drop the gun, Rosano did not comply, which led to the police shooting and, subsequently his death, despite the recovered item appearing to be a gun, the ongoing investigation will shed more light on the circumstances of this tryst. Under the New York State Executive Law Section 70-b, the Attorney General’s Office of Special Investigation (OSI) is obligated to scrutinize any incident where an officer's action or lack thereof, might have resulted in death, whether the officer was on or off duty and regardless of the victim's armed status or custodial situation.
The OSI's mandate, as described, authorizes it to fully investigate incidents in which an officer may have caused a civilian's death, thereby upholding a measure of accountability and oversight.
