
In a move designed to uphold climate science and public health, the City of New York has joined forces with multiple cities, counties, and states to challenge the Federal Government's latest rollbacks on environmental regulations. As per an announcement on the City of New York's official website, the coalition has filed three comment letters staunchly opposing the U.S. Environmental Protection Agency’s (EPA) proposal to reverse the 2009 "Endangerment Finding." This finding recognized greenhouse gas emissions from vehicles as contributors to climate change and a threat to public welfare.
In a series of actions that distinctly aim to protect local economies and the health of their communities, New York City, alongside a band of attorneys general, has not only penned oppositions but also supported legal challenges. According to the City of New York, one such legal push is an amicus brief filed in Environmental Defense Fund v. Wright, aiming to declare the Climate Working Group's report – which downplays the scientific consensus on climate change – as unlawful. An additional challenge sees the city standing firmly against the proposed repeal of existing vehicle emissions standards, a move believed to threaten both the environment and the U.S. auto industry.
These actions resonate with New York City's ongoing commitment to climate budgeting, as reflected in their 2024 initiative where climate considerations were integrated firmly into the city's budgeting process. Mayor Adams emphasized the need for stronger federal regulations to mitigate environmental damage, stating, "Attempts to undermine this scientific consensus should not be the basis for undoing important regulations," in a statement obtained by the City of New York's website. This view was echoed by New York City Corporation Counsel Muriel Goode-Trufant who added, "Now, over the span of a few months, the U.S. Department of Energy and the EPA have sought to manufacture a basis to reject this overwhelming scientific consensus, endangering all Americans and all New Yorkers."
The coalition has also criticized the EPA’s new proposal, claiming it contradicts the Clean Air Act and ignores Supreme Court precedent. The City of New York, along with the attorneys general of states like California and Illinois, urges the EPA to abandon the proposal that threatens to erase necessary legal and scientific safeguards against climate change. Such regulatory enforcement is crucial not only for public health but also for nurturing innovation within the automotive industry, thereby providing consumers with more efficient vehicles and upholding the global competitiveness of American manufacturing.
