A Nogales resident, Erik Alberto Beal, age 28, has been dealt a 32-month sentence for pointing a firearm at a Border Patrol Agent, a charge to which he had given a guilty plea. The ruling was handed down by United States District Judge Angela Martinez, who additionally mandated 36 months of supervised release following his prison term, according to the U.S. Attorney's Office, District of Arizona.

The confrontation ensued on the 11th of April, 2024, when two agents, attired in their Border Patrol uniforms, observed an individual illegally cross into the U.S. near Beal’s place of residence. The agents went their separate ways to inspect the area around Beal's home, resulting in one agent being confronted by a pit bull that was released toward him from a side door. When the agent drew his weapon in response to the advancing dog and began giving loud commands, Beal left his house, secured a semi-automatic handgun from a nearby vehicle, loaded a round, and aimed it at the agent, as reported by the U.S. Attorney's Office, District of Arizona. Another agent arriving on the scene diffused the standoff by drawing his own weapon on Beal, at which point Beal lowered his firearm.

It was the FBI Phoenix Division’s Tucson office that spearheaded the investigation of the case, collaborating with the Customs and Border Protection, Office of Professional Responsibility. Assistant U.S. Attorneys Micah Schmit and Serra Tsethlikai, based out of Tucson, were responsible for the prosecution, as per the announcement.
