
The battle against negligence leading to catastrophic wildfires in California presses forward as the United States Department of Justice has launched a legal offensive against Southern California Edison Co. (SCE). This development comes in the wake of the devastating Eaton and Fairview fires that left countless acres of forest land in ruins, claimed numerous lives, and decimated thousands of structures. According to a press release from the U.S. Attorney's Office, Central District of California, two lawsuits have been filed, demanding that SCE be held accountable for its role in these calamities.
Acting U.S. Attorney Bill Essayli did not mince words when he stated, "The lawsuits filed today allege a troubling pattern of negligence resulting in death, destruction, and tens of millions of federal taxpayer dollars spent to clean up one utility company’s mistakes." The U.S. Attorney's Office, Central District of California, is taking a firm stand, seeking over $40 million in damages for the Eaton Fire, which killed 18 people and burned more than 10,000 structures. Additionally, for the havoc wreaked by the Fairview Fire, which destroyed 44 structures and claimed 2 lives, the United States is pursuing approximately $37 million.
Details surrounding both incidents reveal a disturbing pattern of SCE's alleged negligence. In the case of the Eaton Fire, SCE is accused of failing to properly maintain its power lines and admitting to detecting a fault on its transmission lines around the Eaton Fire's ignition point. The costs of suppression, rehabilitation, and additional environmental damages have been colossal, as reported by the U.S. Attorney's Office, Central District of California. For the Fairview Fire, SCE stands accused of not ensuring adequate clearance between its power lines and another cable, which led to the ignition of the fire.
The United States is seeking to recover about $37 million in damages for losses sustained by the Forest Service, including roughly $20 million in fire suppression costs. Assistant U.S. Attorney Paul Bart Green of the Complex and Defensive Litigation Section is overseeing the Eaton Fire case, while Assistant U.S. Attorney Margaret M. Chen, also from the same section, is handling the Fairview Fire case.
