The incident occurred on May 3, 2022, and began with an argument between Edison Cruz and David Scott, 31, inside a fast-food restaurant on Jerome Avenue. Scott, who was with his wife at the Taco Bell, followed Cruz after leaving the establishment, leading to a continued altercation outside a nearby bodega. A statement obtained by the Bronx District Attorney's Office reports that Cruz then retrieved a 9mm handgun and fired multiple shots, striking Scott four to six times.

The gunfire caused the death of Scott and injured two bystanders, a man who was hit in the bicep and a woman who was hit in the abdomen; both survived. After the shooting, Cruz discarded the weapon in a garbage bag, placed it in a trash can, and returned to work. The NYPD later recovered the firearm.

Senior Homicide Counsel John Miras and Assistant District Attorney Rashad Mujumder led the prosecution, with oversight from Deputy Chief Burim Namani of the Homicide Bureau and others. District Attorney Clark acknowledged the efforts of NYPD Detectives Dominic Robinson of the Bronx Homicide Squad and Orlando Colon, formerly of the 46th Precinct, whose investigation contributed to Cruz’s sentencing. Cruz was sentenced to 22 years in prison and will be subject to five years of post-release supervision, as ordered by Bronx Supreme Court Justice Jeffrey Rosenblueth.
