
A Bronx resident, Ernst Delma, has been sentenced to three and a half years in prison for assaulting an NYPD officer. According to Bronx District Attorney Darcel D. Clark, the incident involved the officer being struck with a bottle while attempting to break up a fight. The sentence, issued by Bronx Supreme Court Justice Tara Collins, also includes three years of post-release supervision. Delma pleaded guilty to second-degree assault on September 19.
According to the details released by the Bronx District Attorney's Office, the incident occurred on August 8, 2024. Officer Mary Fay of the 43rd Precinct came upon Delma as he appeared to be about an to throw a punch at another individual. When she intervened, Delma struck her in the face using a plastic liquor bottle, causing significant injuries which required surgical attention.
“This brazen and unprovoked attack on a police officer coming to the aid of a man will not stand in Bronx County. The defendant has been held accountable,” District Attorney Darcel D. Clark said in a press release. The incident, which was captured on video, resulted in Officer Fay sustaining a fractured nose and a lacerated upper lip that was treated with 13 stitches at NYC Health + Hospitals/Jacobi.
District Attorney Darcel D. Clark acknowledged the response and investigation carried out by NYPD Detectives Felix Delcarpio and Thomas Slocktower of the 43rd Precinct Squad, along with Police Officer Bubacarr Dukureh. The case was prosecuted by Major Case Assistant District Attorney Scott McDonald of Trial Bureau 60, under the supervision of senior officials in the Trial Division.
