David Kingsley, a former New York state prison guard, was convicted of murder in the death of inmate Robert Brooks, who was beaten at Marcy Correctional Facility. Kingsley faces a potential life sentence, with sentencing scheduled for December 15, according to CBS News New York. Two other former guards, Matthew Galliher and Nicholas Kieffer, were acquitted of all charges.

The assault on Brooks occurred last December, and the fatal beating was recorded on body-worn cameras, which drew public attention. Despite the acquittals of Galliher and Kieffer, Onondaga County District Attorney William Fitzpatrick stated that all guards present acted "as a gang" and were complicit, according to information obtained by NBC News. Defense attorneys stated that their clients' involvement did not amount to guilt for the charges.

Brooks, who was serving a 12-year sentence for first-degree assault, had been at Marcy Correctional Facility for only an hour before his death. He was scheduled for release in 2026. Following the trial, five other guards pleaded guilty to manslaughter charges related to Brooks' death, and another guard pleaded guilty to a misdemeanor charge of attempted tampering with physical evidence.

A separate trial for another corrections officer is scheduled for January on charges of second-degree manslaughter. Among the ten guards indicted, six were charged with murder, while three others have pleaded guilty to reduced charges and are cooperating with prosecutors. Two of these guards testified at the trial and confirmed the existence of body-camera footage, according to a statement by CBS News New York. District Attorney Fitzpatrick is also prosecuting guards involved in another inmate death at Mid-State Correctional Facility.

Thomas Gant, a community organizer with the Center for Community Alternatives, commented on the verdict, stating, “There is no justice in this verdict and no justice in this trial. Robert Brooks was murdered not just at the hands of these prison guards, but by a system of human caging that tears apart families and values brutal perpetual punishment over healing and transformation,” as reported by CBS News New York.
